BYU-Hawaii student files lawsuit over sex assault, honor code

The Laie Hawaii Temple at BYU-Hawaii. A former Brigham Young University-Hawaii student has filed a lawsuit alleging the school’s honor code prevented her from seeking help after she was sexually assaulted.

SALT LAKE CITY » A former Brigham Young University-Hawaii student has filed a lawsuit alleging the school’s honor code prevented her from seeking help after she was sexually assaulted.

The Salt Lake Tribune reports that the lawsuit, filed Sept. 30 in Honolulu, claims the Mormon-owned school’s rules banning unmarried students from sexual activity made the victim feel like she could not report her assault. According to the lawsuit the victim had previously been suspended over an alleged violation of the school’s Honor Code.

A BYU-Hawaii spokesman declined to comment on the lawsuit but said the university has a zero-tolerance policy for sexual misconduct.

The woman’s complaint comes as BYU-Provo faces a federal investigation into its compliance with Title IX, which requires universities to follow certain procedures when dealing with sexual assault on campus.

    I am positive that she could have reported the “assault”, it was her decision not to do so.

      BYUs honor code says that you dont have sex while a student at the school, unless you are married. If you violate this rule and the leaders know about it you can be kicked out of the school. I can understand why this and many other female students dont want to report sexual assault because it can ruin everything they worked for to get to college.

      Im glad this is a hot topic and the BYU schools are looking at a solution to allow sexual assault to be repoelrted without the result of being kicked out of school.

        Not being Morman I’m unfamiliar with the rules, but are you saying the victim of a sexual assault would be penalized under the guidelines forbidding unmarried sexual activity?

          The details in a sex assault case would need to be known, but its not unusual where a boy and girl are dating and decide to make out, kissing only, which is not against the honor code, then one thing leads to another with the boy having his way and the girl never wanting to have gone that far (intercourse). Although the girl feels violated she may feel partial responsibility for allowing the kissing part which led to the sex part. This fear of being an active participant is probably what discourages the girl from reporting it in fears that they both broke the honor code instead of just the boy breaking it.

          ..in a rape case where the girl is innocently targeted by a predator she would not be in violation of the honor code.

      Actually more likely the opposite. Schools, like UH Manoa and Kamehameha schools in the past have discouraged students from filing formal charges against other students or faculty, hoping to avoid any criminal charges and reduce negative publicity. If this is the case this woman should have the best attorney in the State to file a lawsuit against BYU-Hawaii for refusing to properly investigate and report her alleged sexual assault. Catholic churches did the same thing by trying to hide all of the sexual assaults by their priests against little boys.

    As one attempts to resort to logic, this story does not compute.

    Being the victim of a sexual assault in no way violates ANY honor code, so we have not been told the whole story ~~ and probably because to do so would challenge the politically correct totems to which all are expected to bow.

    What seems more likely is that the student was reluctant to come forward because she feared she had indeed violated the honor code in some fashion.

    Now of course ~~ since she has lawyered up and has thus been made aware of the money she and her attorney may scarf up plus the Title IX risk exposure of the school and given the politically correct/corrupted judiciary that now can act as a dictator free of checks and balances ~~ she has found the “courage” to lodge her complaint.

      The newest fool political correctness is NO means NO. The girl: Now do it ok. After the man is into it and about to be finished girl: Now I say No and you go to jail for rape if you finish your business. This is all insanity.

    Honor code or no honor code if you are assaulted report it asap. Now days there are perps hiding in every corner of this Earth and growing.

      Erosion of social mores brought about by evolutionary and liberal indoctrination. That’s not to say it is not welcomed. Society cannot remain stagnant. Knowledge dictate the change.. Change accelerate knowledge.
